Supreme Court Confirms Illegality of Croatia Airlines Strike

ZAGREB, August 27, 2018 – The Supreme Court has upheld a Zagreb County Court ruling of 9 August banning a strike at the country’s national flag carrier, Croatia Airlines (CA).

However, unlike the first instance ruling that the Organisation of Workers at Croatia Airlines (ORCA) union did not negotiate a collective agreement in good faith, the Supreme Court concluded that the legal preconditions to allow the strike were not met because conciliation procedures were not held before the union announced it would strike.

After the County Court ruled that the strike was illegal, the ORCA union rejected the explanation that it had not negotiated in good faith and announced that it would appeal the decision to the Supreme Court, saying then that they had gone through the defined procedure. Negotiations with CA’s management board were held on several occasions and as such all the preconditions for the strike to be legal were fulfilled, ORCA claimed.
