ZAGREB, June 22, 2018 – The Zagreb Commercial Court set a hearing for Agrokor’s creditors to vote on a settlement deal for that ailing food and retail conglomerate for 4 July at 8 am.
The Commercial Court concluded that “if the hearing is not completed on July 4 or is not held that day for any reason or is deferred, it will continue or be scheduled for the next day – July 5, at the same time, or possibly July 6.”
All creditors, members of the Temporary Creditors’ Council and emergency administrator in Agrokor are invited to the hearing. The hearing will be held to vote on a settlement deal that was agreed to by the emergency administrator and Temporary Creditors’ Council and was published on the court’s e-board on June 20.
The Commercial Court notes that all creditors whose claims were determined in the amount of unsettled claims have the right to vote.
The court further explains that creditors whose claims have been entirely settled do not have the right to vote nor can creditors vote for the part of their claims that have been partially settled.
Furthermore, creditors of disputed claims will be given the right to vote if an agreement to that effect is reached at the hearing by the emergency administrator and creditors with voting rights. If such an agreement cannot be reached, the court will make its decision at the hearing and it will not be possible to appeal it.
